[greenyes] recycled content mandates in California

California Recycled Content Mandate Expanded

California Governor Arnold Schwarzenegger has signed a bill which will
strengthen the state's recycled content mandate on rigid plastic
containers, eight ounces to one gallon.

The 1991 law had required that if industry did not meet a 25% overall
recycling rate, then companies would have to prove that they were using
25% postconsumer recycled content in their RPPCs, or that they had
source-reduced 10% since 1990. The amendment removes the overall
exemption, so the state will no longer have to calculate the
all-container recycling rate.

The state will now be able to go after companies any time to request
compliance with the law. The state has gone after more than 1,500
companies so far for certification. Food and cosmetic containers are
exempt from the law.
