Kat's recommended strategy (of requiring waste-exporting states to meet the
recycling requirements of importing states) is already law in several states.
Many years ago (yes, I'm an old codger), I served on the Oregon solid waste
commission, which had one goal: stop Seattle's garbage from being landfilled
in Oregon. The legislature approved a differential-rate fee for out-of-state
garbage and a rigid recycling requirement ("you must do as well as Oregon
communities"). The ensuing legal battle went all the way to the Supreme
Court, where it was determined we couldn't use differential (e.g., punitive
rates), but that we could employ the recycling requirement. Of course,
Seattle's program exceeds Oregon standards!
