This mine will impact (destroy?) 1625 acres (nearly 2-1/2 square miles) ofsensitive, sacred land, with pits up to 800 feet deep, with no protection ofground water and downstream sensitive lands. Most major impacts can NOT be mitigated, as pointed outby the Quechen Indians, the Draft EIR, and even Ed Hastey, State Director,Bureau of Land Management (BLM). Ask for NO PROJECT.

If you wrote before: Please write, again, by February 25. Dig up your old letter and send a copyalong with a new letter. (see below) Letters must be received in the BLM office,not just postmarked, by Feb. 25. SORRY for all of us who prefer email, but it seems we must resort to printing on paper and mailing.

All previous comments were reduced to scoping status, and essentially eliminate from the legal record. Please, when you write this time, ask that yourletter -- all comment letters -- be included in the new EIR/EIS.A new, revised Draft document has been issued for a slightly modifiedproject, and it is this document that we are commenting on. Therefore, for our comments to be part of the record, we must write again.

---- BACKGROUND ----

Chemgold's Imperial Project is a proposed open pit, cyanide heap-leach gold mine on Indian Pass Road in eastern Imperial County, 1 mile from Picacho= Peak Wilderness, 3/4 mile from Indian Pass archeological site, 2 miles from= Indian Pass Wilderness, and 2 miles from critical habitat for the desert tortoise,= an endangered species.

This mine would disrupt alluvial plains and wide braided washes which= support large desert trees and shrubs, important sources of forage and shelter for a variety of wildlife. "Mitigation" proposed would be planting seeds and seedlings,.to substitute for huge, ancient, slow-growing trees, to= compensate for the destruction of 100 acres of mature micropyll woodlands, an= endangered habitat.

Pits, waste piles, and leach heaps would destroy 49 archeological sites, and "disturb" 1356 acres of 1598 acres of BLM public lands. It would also disturb 57 more acres for power and pipe lines for wells to the mine site. Four water wells would be drilled, to provide 100 gallons/ minute. One well has already been drilled illegally.

The mine would leach up to 150 tons of ore and leave waste rock piles of 450 tons, with 24 hour operation, 7 days per week, for 20 years. Pits would be 400, 760, and 800 feet deep, one 270 feet below the water= table. Several drainages would be diverted around the mine.

This project is one of the many horror stories of the 1872 Mining Law. Chemgold will pay no taxes, and will leave taxpayers the cost of cleanup= after mining ends, or when this subsidiary goes broke and/or abandons operations. Chemgold is a wholly owned subsidiary of a wholly owned subsidary of a Canadian Company called Glamis Gold, Ltd. Yet it can leave deep pits and 400 foot waste piles fenced with chain link and barbed wire -- and this is= public land!

The biggest pits would not be backfilled -- too expensive, saysGlamis. This proves the mine is not financially feasible, says an expert.Gold prices are now around $300 per ounce and dropping. Glamis once said itwould go away if gold dropped below $300. Glamis, a Canadian company, wantsto leave clean-up costs to us US taxpayers, as many, many mining companieshave done before.The project lies on a west-sloping, pristine area with several unimpairedwashes full of palo verde, mesquite, and ironwood trees, annual plants, andmuch wildlife. The area is the ancestral home of the Quechen Indian Tribe, thesecond largest in California.. The cultural sites, trails, and trade routes(Indian Pass) date back some 10,000 years.The site lies close to two designated wilderness areas and adjacent to theIndian Pass Area of Critical Envirommental Concern (ACEC). The area has aClass L (Limited Use) designation under the California Desert ConservationArea Plan. Class L land uses are =93oriented toward giving priority to theprotection of sensitive, natural, scenic, ecological and cultural resourceswhile placing limitations on other uses which may conflict with these values.Clear enough, say I.

The first Draft EIR/EIS elicited 425 comment letters. (Thank you, one andall!.) BLM was overwhelmed and withdrew the document. The comments werereduced to scoping status. Please, when you write this time, ask that yourletter -- all comment letters -- be included in the new EIR/EIS.A new, revised Draft document has been issued for a slightly modifiedproject, and it is this document that we are commenting on. Thanks to you whoreceived and read the whole 9 pounds.

BLM does NOT have to approve the project; its hands are NOT tied.

The 1872Mining Law itself is subject to regulations under law, including theNational Environmental Policy Act (NEPA), Federal Land Policy and ManagementAct (FLPMA), with it's special section relating to the California Desert: =93Itis the purpose of this section to provide for the immediate and futureprotection and administration of public lands in the California desert withinthe framework of a program of multiple use and sustained yield, and themaintenance of environmental quality.=94 This places the environment on anequal footing with multiple use and sustained yield.Furthermore, there are numerous mandates to the Secretary of Interior to=93prevent undue and unnecessary degradation of the lands and their resources,and to provide environmental protection, especially in the California DesertConservation Area.

Please remind BLM of these mandates, and of their responsibility to complywith them.

The EIS/EIR is inadequate, incomplete, and internally conflicting,disregarding both NEPA and CEQA. We must demand the No Project Alternative=20

Please write. Ask for No Project. Give your personal reasons, and/or useinfo given above. Give the BLM courage and rationale to say NO.

Dear friends, Here is a troubling news from 19th December's Dawn( English Daily of Pakistan)(http://www.dawn.com).=20 Kirthar National Park is the largest wild-life sanctuary in Sindh (and Pakistan) and home to many endangered species of animals, but in its usual style, some departments are willing to cause its destruction by allowing oil exploration in the park. The first step in this process is an Environmental Impact study by the very company interested in doing the oil exploration! It appears the (Sindhi) local officials are taking a stand against the illegal activity, but the Director General Petroleum Concessions Federal Government has decided to bypass them and to let Premier Oil (Britain based multinational) go ahead anyway. Here's the story from Dawn:

Area of Sindh 140913 sq. k.m. Pop. 51300000) SRC's executive authority is vested in the central executive committee (including seven office-bearers) which is elected by the general council every three years.= =20

OBJECTIVES SRC Works to : 1. undertake research work in the fields of education, human rights, environment, wildlife conservation, agriculture, health and culture. 2. apprise the people of rural areas of Sindh of their problems, and bring the said problems to the notice of the peoples of Pakistan as well as other countries of the world. 3. support the sustainable development and relieve the sufferings of=20 disadvantaged and downtrodden people, regardless of their caste, color and creed or religious and political affiliation. 4. promote gender equality, increase women's autonomy and empowerment and enhance their access to information, resources and skills. 5. advocate policy changes in favor of poor and needy. 6. expose the exploitation, corruption and vested interests and cultivate democratic norms. 7. promote establishment of schools, craft, health and community centers in the rural areas with the help of local individuals, groups and support organizations/donor/funding agencies. 8. promote home-based entrepreneurship & self-employment for economic independence of poor and marginalized. 9. undertake relief and mitigation works and combat disasters. 10. create opportunities for capacity building and for close relationship and co-ordination among the intellectuals, academicians, writers, artists, media representatives, students and social workers. 11. promote social, educational and cultural contacts among the inhabitants of various areas, provinces and countries. 12. preserve literary, cultural and historical heritage. 13. organize and hold seminars, conferences, symposiums, workshops, debates, classes, group discussions, Video shows, dramas, cultural shows, fairs and festivals to educate, propagate, preach and achieve the above aims and objects. 14. publish books, journals, reports, leaflets, posters, magazines and periodicals to achieve the above aims and objects.

ACTIVITIES The peasantry in the province of Sindh to which we belong, is among the most oppressed in the world. Our main area of concern is to provide them the database and to educate them. At the moment Pakistan's growth rate of gross domestic product is around three per cent. During 1996-97 agriculture grew by 4%, small scale manufacturing by 6% & services by 4% instead of targeted 5%, 7.9% & 6.1%. Revenue collection is 225 billion rupees against the target of 305. Out of our 140 million population about 72% are jobless and more than 64% male adults & 77% female adults are illiterate, 28% people of our total population are living below poverty line. In the light of the above=20 mentioned facts globalization is appearing as a tool to erode economic stability,=20 national sovereignty and to create a world market for the goods of powerful

multinationals. The awareness and resistance against economical crises,=20 corruption, exploitation and oppression is also growing in our agriculture-based society. In this regard there is a need for a joint platform and=20 coordination of our actions & SRC is working for it. It has over six years of experience of archival and empirical research , using both conventional as well as innovative methodologies. All of Sindh Research Council's research is action oriented and it has given a substantial input to diverse groups working in rural areas of Sindh. In 1994 SRC catalyzed the launching of monthly Subuh Theendo (morning will come) the most popular and largest circulated Sindhi magazine. Our activists and volunteers have been visiting & working all remote areas of Sindh for research, lobbying and advocacy on critical issues like:=20 -Destruction of Khirthar National Park=20 -Ketibunder Project. -Declining Educational Standards. -Women Empowerment -Water resources & National Drainage Program.=20 Our delegates have been participating in different International and Regional conferences and Seminars like Asia Pacific Peace Conference Manila, Women's World Congress, SANA Conference in USA , Indo-Pak Cultural Seminar Delhi, Struggle workshop Amsterdam, Asian Students Conference in Hong Kong etc.=20 SRC also arranges quarterly public programs including Symposiums, debates and cultural events for advocacy and lobbying, and till now it has organized more than 21 largely attended public gatherings on different issues. I am seeking some help with a few projects we haven't had time for here. I have a very small operation and cannot pay large fees, but the topics are of interest to many students out there.=20

Here are the projects -- if anyone is interested, please E-Mail me or Fax me a resume and note.

1. BATTERY RECOVERY LAWS - Need a sharp person -- possibly a law student type -- to summarize battery laws around the world. They are in English, but Japan never translated theirs; Japanese or Chinese helpful. Need your own PC.=20

2. PURCHASING PREFERENCE LAWS -- We have a 1995 report on purchasing prefence policies for recycled products. The copy is quite out of date though the laws haven't changed that much. Need a good reseacher, journalism background and keen interest in environmental issues to make some calls; interviews; and compile information from our past issues and files to update this report. Need your own PC.=20 WordPerfect or ability to load it.

3. ECOLABELLING CRITERIA - Need a researcher with some technical or engineering or chemical writing background to summarize ecolabeling criteria from around the world; keen interest in labeling issues. No language required, though German would be helpful!!

Please forward this around to any associates you might have who might have some time or need a project. I am happy to work with professors for credit if needed.
